General Terms

By accessing our app, C41 Photo Competition, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing C41 Photo Competition. The materials contained in C41 Photo Competition are protected by applicable copyright and trademark law.

Use License

a. Permission is granted to temporarily download one copy of C41 Photo Competition per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

i. modify or copy the materials;

ii. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

iii. attempt to decompile or reverse engineer any software contained in C41 Photo Competition;

iv. remove any copyright or other proprietary notations from the materials; or

v. transfer the materials to another person or "mirror" the materials on any other server.

b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by C41 Photo at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

c. All user generated content from other users is provided for you to view through C41 Photo Competition app only. You agree not to copy, download or distribute any content under any circumstances.

d. You agree not to harvest or collect information, including screen names or any other details of other users

e. You must be over the age of 18 to use C41 Photo Competition. The Competition is not intended for use by children under the age of 18.

Intellectual Property

a. C41 does not claim ownership of content submitted by users, and ownership is retained by the user

b. By submitting content to C41, you agree that you own all copyright to any submissions, and are your own work. You shall be responsible for your own submissions – and warrant that you are not infringing on any licenses, rights, trademarks, copyright or proprietary rights of others. You will not submit any material that publishes falsehoods, submit material that is pornographic, harassing, defamatory, obscene, unlawful, libellous, harassing, hateful, ethnically offensive, or encourages conduct that would be considered a criminal offense or give rise to civil liability, post advertisements, or impersonate another person.

c. By submitting content to C41, you agree to grant C41 the right to display content on C41 services – including app, website, social media profiles as a non-exclusive royalty free transferrable license to copy, store, display content to other users and visitors of C41.

d. If you believe your work has been copied, and constitutes copyright infringement or become aware of any material on the C41 service that is – please contact our privacy officer by emailing privacy@c41app.com with information required for DMCA notification.

e. Users who violate the rules of service including copyright infringements will have their accounts terminated.

Competition Rules

a. All C41 Photo competitions are conducted as skills of contest. They do not constitute a game of chance.

b. Contests of skill are permitted in most jurisdictions, however if they are banned in your area, you agree not to use C41 Photo Competition

c. The nature of all contests will be disclosed, including the approximate value of prizes and deadlines.

d. Competition winners are based on the voting score achieved during the contest.

e. Detailed records for each competition will be kept by C41 for 2 years.

f. These terms will be accessible via the website and each competition page on the app

g. Winners of competitions will be contacted directly to arrange delivery of prizes

h. In case of a tie based on scoring, the winners will be chosen by an expert photographer

i. Verification of Winners – Users will be required to confirm ownership of copyright and intellectual property for any user submission. Any winners who have not abided by the terms of service will be disqualified the competition and prizes will be awarded to the next competitor. Should the winner reside in a country where delivery of prizes is prohibitive, C41 Photo will offer cash payment via Paypal equivalent prize.

j. All prizes will be sent within 30 days of the end of competition.

k. By entering any contests, each user releases and holds harmless C41 Photo, relevant affiliates and any prizes received. Users are responsible for any tax implications of winning a prize

l. Any user found to be tampering with the contest process – including hacking, fraud or use of automated bots will be disqualified from C41 Photo and barred from the service.

Disclaimer

a. The materials within C41 Photo Competition are provided on an 'as is' basis. C41 Photo makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

b. Further, C41 Photo does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to C41 Photo Competition.

Limitations

In no event shall C41 Photo or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use C41 Photo Competition, even if C41 Photo or a C41 Photo authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Accuracy of materials

The materials appearing in C41 Photo Competition could include technical, typographical, or photographic errors. C41 Photo does not warrant that any of the materials on C41 Photo Competition are accurate, complete or current. C41 Photo may make changes to the materials contained in C41 Photo Competition at any time without notice.

C41 Photo has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by C41 Photo of the site. Use of any such linked website is at the user's own risk.

Modifications

C41 Photo may revise these terms of service for its app at any time without notice. By using C41 Photo Competition you are agreeing to be bound by the then current version of these terms of service.

Your privacy is important to us. It is C41 Photo's policy to respect your privacy regarding any information we may collect from you through our app, C41 Photo Competition.

We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used.

We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.

We don’t share any personally identifying information publicly or with third-parties, except when required to by law, or to improve the service we provide you.

Our app may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies.

You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services.
